A federal judge has dismissed a lawsuit brought by actress Rose McGowan alleging that Harvey blackmailed Weinstein to silence her and derail her career before accusing him of rape.
Judge Otis D. Wright II dismissed the lawsuit on Monday because McGowan, who had fired her attorneys last month and was acting as her own attorney, failed to meet their extended filing deadlines.
Wright had dismantled much of McGowan’s suit last year, but now thrown it away entirely. Her central claim that Weinstein violated federal extortion law has been openly dismissed, so it cannot be re-filed.
Weinstein spokesman Juda S. Engelmayer said in an email on Tuesday that “out of the public eye, with reasonable time, legal work, evidence and facts, this is the way we believe these lawsuits will all ultimately come to an end.” . The 2019 lawsuit filed in Los Angeles said Weinstein, along with two of his former lawyers and an Israeli intelligence agency, conspired to defraud, defame and marginalize McGowan as she prepared to kill Weinstein in the lead-up to the explosion of the # MeToo movement at the end of 2017.
The Associated Press does not usually name people who claim to have been victims of sexual abuse unless they come out publicly, as McGowan has repeatedly done.
In another Los Angeles courtroom, a judge on Tuesday denied a motion by Weinstein’s attorneys to dismiss a criminal charge against Weinstein for 11 sexual assault charges. Weinstein’s attorneys had argued that an expert on “rape trauma syndrome” was abused by prosecutors in testimony of the grand jury.
Weinstein has pleaded not guilty to four rape cases and seven other sexual assault cases. He is waiting for his trial. No date has been set.
The 69-year-old former film mogul is serving a 23-year prison sentence after convictions for rape and sexual assault in New York.
