Britney Spears’ Independence Day may have finally come.
At a hearing in a downtown Los Angeles courtroom on Friday, a judge will decide whether to end the conservatory, which has held vast control over the pop superstar’s life and money for nearly 14 years.
Without significant resistance from those involved, it seems likely that Judge Brenda Penny will dissolve the legal agreement. Britney Spears’ attorney, her parents, and the officers who control the conservatory all publicly support the termination.
Jodi Montgomery, the restorer who oversees the singer’s life and medical decisions, has worked with her therapists and doctors to develop a care plan that will guide her through the end of the restoration and its aftermath.
But Penny has given no overt signal to her decision, and she wields considerable discretion and power. Legal or bureaucratic hurdles, or ongoing concerns about Spears medical care or finances, could slow the seemingly inevitable end even more.
A judge ruled Wednesday that in the “best interests of Britney Spears” Jamie Spears has been suspended from the singer’s conservatory.
It’s not clear if Spears, 39, will be attending the hearing. Fans who have claimed the #FreeBritney Court, which she credited with getting them to this point, will be outside the courthouse in significant numbers.
Penny stood firmly on the side of Spears and her attorney Mathew Rosengart at the last hearing in September when she suspended the singer’s father, James Spears, from the conservatory, which he had at least partially controlled since his initial petition in 2008.
The judge found no wrongdoing against James Spears, only said that the “toxic environment” made the move necessary.
“The current situation is untenable,” said Penny.
Prior to that hearing, James Spears reversed course and supported the termination of the Conservatory. Rosengart argued that he should be suspended and not play a role in the final game of the legal deal. He has vowed to conduct an investigation into James Spears’ dealings with the Conservatory after it has ended.
James “Jamie” Spears filed a petition Tuesday claiming that his daughter “has the right now to have this court seriously consider whether this Conservatory requirement is no longer necessary”.
The attorney said he plans to look at the actions of James Spears and his agents “top to bottom” and suggested that law enforcement investigate the revelations in a New York Times documentary about a wiretap in his daughter’s bedroom.
James Spears’ attorneys said Rosengart’s allegations ranged from baseless to impossible and that he always acted in his daughter’s best interests.
In a way, the struggle for the conservatories has already begun. James Spears has broken up with the lawyers who helped run it and hired Alex Weingarten, an attorney who specializes in the type of litigation that may come.
And in last week’s court records, Britney Spears’ former executive director, Tri Star Sports and Entertainment Group, has dismissed Rosengart’s demands for documents regarding his involvement with the Conservatory from 2008 to 2018. The group also denied any role or knowledge of any surveillance of the singer.
Six months ago it seemed that the Conservatory would continue to exist indefinitely. It has since unraveled at a surprising rate.
The key was a speech Britney Spears gave at a June hearing in which she passionately detailed the limitations and scrutiny of her life which she described as “abusive.”
Since the #FreeBritney movement began in 2019, Britney Spears has never spoken publicly about the 13-year-old conservatory that fans believe was abused for the personal benefit of her father Jamie.
She called for the Conservatory term to end without a curious assessment of her state of mind.
Legal experts said at the time that this was unlikely and would represent a departure from standard court practice.
Now it seems that she is getting exactly what she was looking for.
